Clause 5 - Exchanges, Defects and Guarantees

 

If the purchased product is received with a manufacturing defect within the warranty period governed by the Consumer Protection Code of your country, the product will be replaced with an identical item, or a similar one, or any other product on the website, with these being sent and delivered within the same estimated timeframes as when you first purchased it.

Any price differences, if lower, will be refunded to the customer's bank account by Simple Market, or as account balance with the payment intermediary selected at the time of purchase, or credited to a credit card statement; any price differences, must be paid by the consumer.

Under no circumstances should products with alleged defects reported by the customer be sent to Simple Market's headquarters, to a collection point determined by the company, in their original packaging with all items related to the product: accessories, cables, power supplies, manuals, packaging, etc., along with a brief description of the defect found by the customer, to determine whether or not there is a manufacturing defect, all at Simple Market's discretion. The customer has 7 days from the date of their complaint to return the defective product. Simple Market reserves the right not to accept requests for replacement, refunds, or receipt of the defective product outside of this period.

Shipping costs for returning the product will not be charged to the customer if a genuine manufacturing defect or generalized damage caused by the carrier during transport is found.

We are not responsible for any errors made by the customer at the time of purchase in filling out the characteristics (color, size, model, etc.) of the chosen product. Therefore, it is essential to pay attention to the details contained in the product description and the images in the listing before completing the purchase, and if you still have any doubts, contact us through the channels available on the website to resolve them before payment.

 

Clause 8 - Returns, Cancellations and Refunds

 

Simple Market operates in accordance with the laws of the country in which it is based, Brazil, and in particular the Consumer Protection Code, as well as the laws of other countries in which it advertises and sells, all to comply with the rights and duties of both parties in the consumer relationship.

Therefore, Simple Market determines that, in requests for cancellation due to buyer's remorse or any other reason, immediately after payment confirmation, cancellation requests will not be accepted, since payment will already have been made to our Suppliers for the items contained in the customer's order through our website, except if the product is out of stock at the Supplier, in which case the purchase will be automatically cancelled and the amount refunded. However, once the purchase is completed and the customer's payment is confirmed, they automatically agree to the Terms and Conditions of this Contract. The customer is advised that their cancellation request will only be processed if they notify us again of their decision after the product has been refused upon delivery so that it can be returned to its origin, or, if received, provided that the product remains in its original delivery condition (unused and in its original packaging) and is returned. The customer has 7 days from the date of delivery to return the product, free of charge. Simple Market reserves the right to refuse cancellation requests or product returns outside of this timeframe.

In cases of non-compliance with the agreed delivery deadlines, including rescheduled ones (see Clause 3), through no fault of Simple Market, the company may offer the customer the option to accept a new shipment (reshipment) of another product within the same shipping and delivery deadlines as when the purchase was made, or to cancel the order. It is agreed that, in cases of cancellation, the customer will receive a refund of the amount spent on the purchase, processed and deposited within 30 (thirty) days of the customer's request and provision of bank details to Simple Market. This amount will be refunded in full to the bank account provided or through the payment intermediary or gateway that processed the purchase.

It is also agreed that the aforementioned refund will be permanently suspended (cancelled) if, during its processing time, the product delivery has already been completed.

This Contract remains in effect until its provisions are fulfilled, regarding refunds already made to customers for delivery delays caused by the Postal Agent or Carrier, as the refund does not interrupt the delivery already posted by the Supplier (except in cases of actual loss in the postal flow or cargo theft). Therefore, upon receiving the order and intending to keep it in possession while it is already in use, the customer must contact Simple Market to request a refund via bank slip, which will be provided, or the return of the product in the same condition as received (as new).

The company will not accept returns of products that have been used. In these cases, a refund will be requested.

No installment payments or any type of agreement will be accepted for refunds. Furthermore, when a refund is processed, it will be returned in full without any agreement.

The company reserves the right to contact the customer for collection purposes if they have not contacted us voluntarily. If the established agreement is not met, the customer will be subject to administrative sanctions, such as the protest of the unpaid invoice, and legal sanctions, which may include being classified as "embezzlement" under the terms of the Penal Code of their country.

Customers are not allowed to keep the product free of charge.

For orders subject to taxes or duties that do not comply with Clause 6 and for which the customer has not agreed to payment, a refund may only be requested once the product has been returned to its origin (Supplier). Therefore, and being entirely responsible for monitoring the return of the product, once it arrives at the Supplier, the customer must contact Simple Market through the channels available on the website to request the cancellation and refund of their purchase. Simple Market is not responsible for monitoring the return and delivery of the product to its origin, since the tracking code was provided to the customer to follow the shipment from the time of posting.

Simple Market reserves the right to automatically cancel the order and refund the amount paid if, after the purchase is completed, the product is out of stock at the Supplier. The customer will be duly informed of the occurrence.
